Chapter 7 & Chapter 13 Bankruptcy Filings Fees Will Increase on 6/1/14
The Judicial Conference approved new filing fee increases that will become effective June 1, 2014. What does this mean? After June 1st, it will cost slightly more to file for bankruptcy protection. What is the Bankruptcy Filing Fee?
The filing fee goes to the court when your petition is electronically filed by your attorney. The money is used by the court to process your paperwork and pay for the administration of your case. The reason that the Chapter 7 fees are slightly higher is because a portion of those funds are given to a court-appointed Trustee. This Chapter 7 Trustee will review your bankruptcy paperwork to determine if there are any assets to liquidate for the benefit of your creditors.
What are the New Bankruptcy Filing Fees?
Nothing else is changing about the Michigan bankruptcy process or your legal rights to file for bankruptcy protection. It is simply a fee increase. Here is an overview of the new fees:
- For filing a petition under Chapter 7: $335
- For filing a petition under Chapter 13: $310
You pay this fee to the law firm filing your case and they in turn remit the funds to the court electronically when your case is filed. Bankruptcy protection is immediate once a case number is established.
